"...she has got away without punishment."

A reader sends in this article from the Daily Mail illustrating what can happen to a man's life when falsely accused of rape:

A BBC personality has shattered her ex-boyfriend's life by falsely accusing him of rape.

The woman, who has broadcast to television audiences of millions, accused him of raping her 40 times throughout their two-and-a-half-year relationship.

He was arrested, held in a police cell and handcuffed as police searched his flat for evidence of his crime. But she retracted her allegation weeks later, and the officer investigating the claims described them as 'inconsistent' and 'not credible'.

Despite the lack of evidence, the incident remains on the Police National Computer thanks to a legal loophole, which campaigners say is blighting the lives of falsely accused men.

Even if the 'victim' withdraws their allegation, it will show up under enhanced Criminal Records Bureau checks that are undertaken regularly on people who apply for jobs with employers such as the NHS or schools. It will also prevent them from travelling to the United States.


Men are viewed as guilty even if found innocent. Women are viewed as innocent even when found guilty. This sexism under the law needs to change.

I wouldn't counsel holding your breath while you wait. Sexism, like racism, is now a fully institutionalized policy under the United States code and the "family laws" of the several states. Women have been accorded the status of victims de natura,, which is a particularly difficult award to retract.

It occurs to me as I write this that victim status, once awarded, is today more staunchly protected than property rights under the Kelo- eviscerated Fifth Amendment. If that doesn't scream something about the degeneration of American law and social practice, I can't imagine what would.

This reminds me of a recent case on Ireland in which a woman neglected her children and raped one of her sons. The judge could have imposed a life sentence for the incest had the perp been male. However, since it was a woman, the judge could only sentence the woman to seven years.

In many of these situations, one can eventually be forgiving of the woman, or at least arrive at indifference, if perhaps she isn't "wrapped tight". But for the life of me, I can't understand why an accusation or accusations are allowed to stick, when known to be false. It ruins a person's life. Guilty, although proven innocent.

I guess that until enough men are accused (obviously, men don't have to be convicted) of this, and band together as "victims", forming some sort of social movement and democrat voting block, it won't change. That's sarcasm, for those who live in and around the beltway.

Men have to make their way on their own in this life, unless they can elbow their way into some sort of victim group. I wish all men would see this, and become conservative voters. There is no reason that makes any sense for a self respecting man to be a liberal democrat.

Be wary of quoting anything from the Daily Mail unless you have verified from an independent source. Particularly anything that has to do with sex.

It's a good place to see photos of topless movie stars and to find out who is banging whom. For news, not so good.

At the moment the lead headline is Lavish Knees-up at the Treasury, and the lead photo is some cute young blonde lady dumping Prince What's-his-name.

By the time you click this link, it will be something different.

Same here. The secretary of the department in which I worked once fabricated a sexual harassment charge against me. Even when the "witness" that she named stated (truthfully) that the alleged incident never occurred, my employer refused to expunge the allegation from my record . . . until I made a sexual harassment charge against the woman who told me that it couldn't be expunged. After all, "we have to take all allegations seriously".

I used to really think that a woman wouldn't make something up out of the blue (like sexual harassment or rape). I really thought that.

A secretary was fired in our department and she then sued the company, alleging sexual harassment in different ways from each man (3 in all) who worked with her. She made plausible allegations that fit each man's personality, but they were absolutely untrue.

The suit only got as far as a deposition, in which she repeatedly contradicted herself, and her attorney then unilaterally pushed for her to drop the suit (or he would withdraw representation).

It still shook me up though that women can feel justified in complete fabrication because of a perceived injustice.

What could this possibly mean? She is not some child held in chains, but a "BBC personality"...

I am staggered that such a claim would even have the status of rape...if a free adult woman carries on with a man for that long and...

And no penalty for her?

I did a little bit of an Internet search. The only news source that seems to be discussing this story is The Mail. Since there is no mention of names, either the alleged victim or alleged perpetrator, one can't find out much more information about them. There are no references to police spokespeople. The alleged news source says they research the story through police records obtained through a Freedom of Information Act request, but we don't know of what.

I'm not saying this story is fabricated or it isn't, but it certainly could use some shoring up, ideally from a more reputable source.

It's the woman's justification. I just had to read what a woman says about herself and how she describes it in a genuine case of paternity fraud. It was pretty much just like I imagined.

I still think that people are VASTLY underrating this issue. It's not that people don't think it's wrong, of course. It is just that it is SO wrong. This is as bad or worse than a man brutally physically beating and raping a woman. I mean, this is up there with crippling a person at least. It's beyond purely psychological. We should all be debating whether this woman should EVER be allowed in civil society again or if we should just throw away the key. Instead, we seem to be debating whether or not the duped man should be more loving to the girl that isn't his daughter.

Oh well. When a bunch of savage Muslim terrorists take over just because that society is actually the least corrupt in the world (!) and offers the most justice (!), I guess this will all change.

i am not surprised anymore, as i get older and older, the more i see women as being less caring, that men are to be ridiculed, thought as a walking wallet (yes i am back been out of it for a bit).

its a good job i have given up on the whole dating scene. The negatives outweight any positives

I agree with SGT Ted here, why isn't this man going after her for every penny that she will ever be worth under British libel law, since their statute (IIRC) does not require that you believe a statement to be true, nor does it require evidence from others that you intended to cause harm.

No, I'm more likely someone who gets a kick out of guys who are always feeling their pulse and extremely nervous about whether they are "real men" or not, and who can also be easily manipulated by any woman who questions their Real-Man-ness (usually in order to get them to do something or more likely to get money out of them).

So I thought people would understand my sarcasm, but apparently they (or just you) don't.

Oh, one more point: Men who are easily manipulated by the "real man" thing are not only not real men (LOL), they are also stupid. Even if they have a brush haircut and push around men smaller than themselves.

I'll give MB some latitude. There does seem to be a percentage of men that are very concerned about how they are perceived by others, particularly other men. Call it the "real men" phenomenon or "alpha males" or whatever you want, some men do look to a social code or sometimes the comments of other more outwardly manly men to dictate their words and their actions.

This article cited my Web site, False Rape Society, and quoted one of my co-bloggers about anonymity. We commend the author for calling us. We said: 'Thousands of innocent men are tainted for ever by an unfair system,' he said. 'The accused should have the right to remain anonymous until a conviction. If they are cleared, the incident should be erased from their records.'

That simple change would go a long way toward relieving some of the pain of the falsely accused.
